This Return Policy explains the terms and conditions under which refunds and returns are managed for our services. This policy complies with applicable laws in Spain and the European Union, including directives protecting consumer rights. Please read it carefully to understand your rights and obligations.
1. Scope and Applicability
This Return Policy applies to all customers within Spain and the European Union (EU) who engage ModWebDev for software development services. All services are priced in euros (€).
We operate under the guidelines of the Directive (EU) 2011/83 on consumer rights, as amended by Directive (EU) 2019/2161, ensuring transparency and fairness in transactions. Additionally, this policy complies with Spain’s specific consumer protection laws, including the General Law for the Defense of Consumers and Users (RDL 1/2007).
2. Refund Eligibility
We understand that circumstances may arise where refunds are necessary. Below are the specific conditions under which refunds may be granted:
2.1 Non-Delivery of Service
If we fail to deliver the agreed-upon software development services within the specified timeline due to reasons attributable to us, you are entitled to a full refund. This includes failure to meet deadlines or incomplete delivery of promised features.
2.2 Quality Assurance
Should the delivered service contain defects or fail to meet agreed-upon standards or specifications, we will work with you to resolve the issue. If the problem cannot be resolved within a reasonable timeframe, you may request a full or partial refund.
2.3 Cancellation by the Customer
- Before Project Commencement: If you choose to cancel the service before work begins, you are entitled to a full refund.
- After Project Commencement: If the project is canceled after work has started, the refund will be prorated based on the amount of work already completed.
3. Exclusions from Refunds
Refunds will not be granted under the following circumstances:
- Accepted Work: Once the service has been delivered and explicitly accepted by the customer.
- Customer-Related Delays: If delays or project interruptions occur due to insufficient communication, missing input, or unresponsiveness from the customer.
- Custom Solutions: Refunds are not applicable for custom software solutions where substantial work has already been completed.
These exclusions align with the Directive 2005/29/EC on Unfair Commercial Practices, ensuring that refunds are fair and reasonable for both parties.
4. Refund Request Process

- A clear explanation of the issue and the reason for your refund request.
- Supporting documentation, such as invoices, agreements, and correspondence.
Refund requests will be assessed in compliance with Regulation (EU) 2016/679 (GDPR) to ensure your personal data is handled securely.
5. Refund Processing Time
Once we receive your refund request, it will be reviewed within 7 business days. You will be notified of the decision via email. If approved, the refund will be processed using your original payment method within 14 business days from the approval date.
In cases of disputes or delays, you have the right to seek assistance through your local consumer protection authority as per Regulation (EC) No 861/2007 on small claims procedures in the EU.
6. Consumer Rights Under EU Law
As a customer within the European Union, you are protected under the Directive (EU) 2011/83 on consumer rights, which ensures:
- Transparency in the terms and conditions of services.
- The right to withdraw from a service contract within 14 days in certain cases (where applicable).
Note that services provided by ModWebDev are custom software solutions and may not always fall under standard withdrawal rights due to the nature of the work.
7. Governing Law and Jurisdiction
This Return Policy is governed by the laws of Spain and the European Union. In the event of disputes, they will be resolved under the jurisdiction of the courts in Zaragoza, Spain, as per Regulation (EU) No 1215/2012 on jurisdiction and enforcement of judgments.
